What’s a Patent Search?
Hi there! I’m JD Houvener, a patent attorney and founder of Bold Patent Law Firm. Over the years, I’ve worked with thousands of inventors and helped secure nearly 500 patents. Today, let’s talk about a key step in the invention process: the patent search.
What It Is
A patent search is exactly what it sounds like. It’s research to see if your idea has already been patented or publicly disclosed. Think of it as fact-checking your invention. You don’t want to invest time and money only to find out someone beat you to it.
There are two main areas to check:
- Existing Patents: These are patents that have already been granted.
- Applications: These are published patent filings still under review.
Both are important because they show whether your invention is new and unique.
Why It’s Important
A thorough patent search prevents unpleasant surprises. If someone already patented something similar, you won’t get approval. It also looks at what’s called “prior art”—basically anything that could block your patent, like:
- Products on the market.
- Articles, journals, or online posts.
Even if someone didn’t file for a patent, their work might still count against you.
Can You Do It Yourself?
Yes, you can start with free tools like:
- Google Patents
- USPTO Patent Center
- WIPO Search
These tools are helpful but have limits. If you’re serious, it’s worth hiring a patent attorney. They’ll dig deeper and help answer the big question: Should you file for a patent or not?
The Bottom Line
A patent search is more than just a list of results. It’s about understanding if your idea is truly worth patenting. Is it new? Is it different? That’s where an attorney comes in—they help you make that call.
