In late 2020 when I decided to file my patent applications, I spoke with JD at Bold Patents on a Zoom call. The service fee was a little over my budget at the time, so I decided to go with a cheaper firm. This was a BIG MISTAKE that almost cost me my patent.
I finally started the patent application process in 2021. It was confusing from the start and was almost impossible to speak with a patent attorney directly. My questions were taken by a para-legal and communicated to an attorney, after which I would get my answers, which took time and was frustrating.
We filed the application and due to insufficient technical details, received a rejection from the USPTO. In a panic, I hired another attorney to respond to this rejection. When the new attorney discussed the rejection with me, I was told that winning this patent would be a “long shot.” However, he could write a response based on what I think is different between my invention and the prior art. In other words, I was asked to provide the technical grounds for fighting the rejection. Finding the differences and uniqueness in my invention should have been the job of the patent attorney, not mine.
I was lost and felt helpless again, finding myself trying to defend this patent application alone with no one to help in terms of technical expertise. I had put in all my time, effort, resources and energy into this project, even having produced physical samples of my invention and here I was, facing this rejection only due to a lack of technical understanding of patents.
One day, while checking my email, I saw an email from JD because Bold Patents sends out monthly updates on patents. I decided to call JD again and discuss my situation. That call changed everything for me and my patent application. JD graciously accepted to be the new attorney of record for my patent application. He assigned one of the most senior patent attorneys, Houda El-Jarrah to my case.
Just from my first call with Houda, I was fully confident that Bold Patents would successfully make my case with the USPTO and together we would win this patent. Houda and her team argued my case and provided the necessary technical justifications and reasonings for the USPTO examiner to be convinced beyond any doubt that my invention was unique.
