Question:
Firstly, can I register two different words in one application? I see there’s an option, but both words I’m trying to register are different. Could it be that one is different than the other?
Answer:
Matt: If there are two separate trademarks, you can’t register them together. It sounds like you might have two words that you’re using together as a trademark. In that case, yes, you can register those together. You can register them as word marks together or design marks together.
JD: An example might be “Brush Hold” or “Bold IP.” Both examples have two words,
Matt: But you can register them together as a single trademark application.
JD: Another example could be “Bold Intellectual Property.” All three words could be used together, and you can file them as a single trademark application.
JD: However, if you have two separate brands, such as “Sonic Soda” and “Bubbles Swimwear,”
Matt: you would need to file those separately. They won’t be displayed together, and consumers won’t think of them as a singular brand. Therefore, they need their own trademark applications. There’s no way to add second or third word marks or design marks to a single application.
Matt: You can, however, add multiple classes to an application. For instance, you could be in the legal services category, the apparel category, and the information services category all in one application. But you can’t have multiple trademarks in one application.
