Florida Patents In Industries

Many industries and individuals in Florida secure patents for their creations. In 2021, the engineering and tech industries were the top inventive patent-earners. From 2008 until 2012, there were 14,042 granted utility patents in Florida. Industries that produced computer and electronic products, as well as individuals creating in those industries, were granted 5,644 patents. The computer and electronic industry includes categories such as:

  • Communications equipment, which was granted 1,812 patents
  • Computer equipment and peripheral equipment, which had 1,603 patents granted
  • Navigational, electromedical, control, and measuring instruments, which had 1,378 utility patents granted

In the same period of time, there were 1,857 utility patents granted for miscellaneous manufacturing industries, more than half of which were for medical supplies. There were 1,871 patents granted in the machinery industries.

Although corporations have the resources to file for and secure more patents than an individual, any person can file for a patent when they create an invention. In Florida, from 2011 to 2015, 4,952 utility patents were granted that were considered individually owned. This includes patents that had unassigned ownership when the patent was granted, as well as patents owned by an individual, not an organization.

If you believe you’ve made a new and inventive creation, you have the ability to file a patent, which can benefit your existing business or allow you to create a new business. A patent attorney can help you navigate this process.

FAQs:

How Do You Get a Patent in Florida?

You can get a patent in Florida by filing with the U.S. Patent and Trademark Office. You must determine whether your invention qualifies for a utility or design patent, or both, and conduct a patent search to determine if your creation is new. If your invention does not infringe on any other patents, you can begin crafting an application for the patent. This application will include significant documentation of the creation, ownership, and use of the product. An attorney can help with this process.

Can You File a Patent Without a Lawyer?

You can file for a patent application without a lawyer, although it isn’t recommended. An attorney who focuses on patents and intellectual property law is a beneficial asset during the process of obtaining a patent. They can help you determine the eligibility of your patent, draft your application with the proper documentation, and help you navigate the proceedings that follow.

Without an attorney, you may spend significant money due to improperly filing an application. An attorney makes the process easier and more efficient.

How Much Does a Digital Patent Cost?

How much a digital patent costs depends on several factors, including the type of patent being filed. Most digital patents cover software methods and programs, which fit under the category of a utility patent.

  • The U.S. Patent and Trademark Office’s basic filing fee for a utility patent is $320.
  • If you qualify as a small entity, the fee is $128.
  • For micro entities, the fee is $64.
  • The fee is $64 for small entities filing electronically.

There may be additional fees to file for a digital patent.

Do Patent Lawyers Argue in Court?

Patent lawyers can argue in court. If you are in need of an attorney to defend your patent in court, it is crucial to look for an attorney with experience in patent litigation. If another party is infringing on your rights listed in a patent, you have the right to legal action. This may occur if another party sells, imports, offers to sell, or uses the item on which you have a patent. A patent litigation attorney can create a strategy to defend your interests and secure relief.
