Welcome to the Bolden Vener show. I’m JD Houvener, your host, co-hosted with Matt Kulseth.

Matt, good day.

That’s me, hello! Oh man, all right, how are you today? What’s going on?

I’m doing great, man. I’m still, uh, digging out from like 500 emails. So I’m, uh, I’m almost through them. I’m down to my last 100 emails.

Well they say, I’m gonna try to get the saying right off the bat, they say to not dig a bigger hole, you’ve got to put the shovel down. But you’re digging out of the hole!

It’s just, yeah, I mean, it’s it’s pretty brutal out there, man. I mean, it’s kind of funny because I’m responding to emails, you know, the clients are emailing back and it’s like, oh, you know I just want, I just want to respond to these emails and be done. But yeah, I mean, this is good. When I was at Boeing I would take attacks sometimes when I was so busy with email, it’s just, you just stand there and you can just not respond to the first one. And if they really want it, then the second, so, okay you really wanted it, oh it was important, you didn’t find the answer, you do actually need help, as an initial filter. But that was back when I didn’t, my own, my own business. So I totally understand, you want to make sure you do, you know how it is, it’s the 80/20 rule, right?

Yeah, for sure. When it comes to clients, well, today I’ve got a really, really good bold bite. We’re gonna take a full 15 minutes on that. My first half of the show, we’ll do live Q and A if we’ve got any. And just to, if anybody’s has not seen us or heard us, we’re both attorneys and we’re with Bold Patent Law Firm. I’m a patent attorney, he’s a trademark attorney. And so we kind of, we double header hit it, both subjects, take any questions honestly. And we’ve got, I’ve got five preloaded questions for you Matt, all on trademarks.

I love trademarks! Trademarks, trademarks, trademarks, trademarks! My whole life is trademarks!

Yeah, right on, man! Well, hopefully they’ll be fun. There’s a couple out of from Reddit throughout the week. I’ve got one of my reps, you know, Mia, she’s, you know, she pulls some questions for us. And we’ve had a lot of interest in brands maybe this time of year. People are shopping, thinking about their own products and looking to, you know, step into that themselves, whether it be on the side or as a full-time gig.

You and I just chatting before the show, I’ve got a cup of tea here from one of our clients, BB. And you know it’s, it’s a cool, it’s a black and white mug. But you have to know if is it a color logo or is it a black and white logo? It is a color logo!

Yeah, but she used it in black and white.

Generally speaking, we file black and white grayscale trademark applications. So not, is there a, is there a reason you get a broader set of protections right if you are claiming color as part of the trademark application process you’re limited to those colors. So if somebody has a similar design but they’re using it a different color it’s not as easy to establish a likelihood of confusion between the two marks. Whereas if you had a, uh, black and white or grayscale application and you don’t claim color, conceivably then you are claiming color for all colors, right?

So, okay. Right. Sometimes it’s what you don’t say!

Exactly. And also we don’t want clients to file trademarks in certain colors and then five years change the color scheme up to, you know, go along with a new brand theme. So yeah, the longer we can preserve the, the use of those logos for clients, the better.

Love it. Speaking of logos and coffee mugs, we’re doing our, our Bold mug giveaway. This is the original Bold mug. Oh, I gotta get one of those, man! So this is the, this is way you can see we got the TM there. We’re following, yeah, before we registered, before my time, I think we’re doing a new run. We just designed it of course with the circle R registered mark. So one side has got Bold, Bold Patent logo. The other side is Go Big, Go Bold and big bold letters. So we got all the registrations now!

Yeah, I did that email went out last week and we are asking for our clients in those in the database to introduce us to a friend. Just give us information, share the Bold news with someone you might know and get yourself a mug. If you’re new to the show, new to this community, I encourage you to give us a like wherever you’re at – on LinkedIn, Facebook or YouTube. Subscribe on YouTube. I’m looking to grow our network. I push out a brand new video recorded every week from me every Tuesday. So don’t miss that, that’s on our YouTube channel.
