Happy Friday everybody, you’ve made it! This is the end of our deep dive into looking at patentability search opinions and your big five options you’ve got for moving a forward. That’s what we’ve talked about – everything from not doing a search at all to doing it yourself to hiring it sort of cheap LegalZoom firm to a patent agent. Today we’re talking about polymer working with a patent attorney to do it right.

Do work with a patent attorney is the best alternative and in fact I’ve we as we’ve learned it’s the only option you really have if you want to move your technology to the next level and to make sure you’re making a good investment from a business point of view in filing that patent application. By working with a patent attorney you’re gonna cover the gambit on eligibility, novelty, non-obviousness and utility, making sure you’re meeting all the marks that say “Yes, we recommend that you move forward.”

One thing that we’re proud of that bold pens when we do a full patentability analysis and deliver that opinion, that legal opinion, is that we end up telling 40 to 50 percent of our clients we don’t recommend filing. And while that’s sort of a negative connotation, we actually love it because it gives our clients a truth. And we don’t stop there; we don’t just say “Sorry you’re out of luck.” We go back to the drawing board and work with our inventors to help them design around prior art that already exists. We take it that extra step because we care. We realize that you’re a creator, you’re an innovator and just because someone else has done largely what you’ve got doesn’t mean you can’t innovate around it and shouldn’t. You shouldn’t stop there.

What’s important too is that we’re not going to just file a patent so you can get this small little tiny smidge of a path. And sure we can likely get you a patent on whatever you’ve come up with in a very minute area, but we want to make sure that it’s gonna deliver value for you. The last thing we want to do is have a patent granted and have it just sit on a shelf somewhere and never hit the market place. So in our opinion, we also add in a business mindset and hope you think about your goals and as we’ve talked about we’ve got your business plan and to think about how this is going to fit into that plan in terms of moving forward.
