The sports and fitness industry has grown exponentially in recent decades, thanks in large part to continued innovation in the products, gadgets and technologies used by recreational athletes and sports professionals alike. While much of this innovation has been driven by major corporations, many ground-breaking products came to fruition because of ideas hatched by entrepreneurs and start-up companies focused in one way or another on sports.

If you have an idea for a product (or a product innovation) related to sports, you should understand what sports patents are and how they can protect you. Ultimately, anyone can apply for and obtain sports patents, including individuals who have novel ideas for sports-related products.

Continued Innovations in Sports Equipment Elevate the Game

Sports and fitness, of course, are not new. However, the tools and devices we use to play and enjoy them have changed over the years and continue to evolve.

Perhaps the most recent innovation is the use of AI in sports training. AI is being used more frequently as a personal trainer that can advise the user on the proper way to complete an exercise. Typically, this involves human pose estimation technology that analyzes the posture of an athlete and provides feedback.

For another example, advances in athletic shoe technology and athletic wear have improved wearers’ performance and experiences. Innovative designs for basketball backboards, protective football helmets and uniform equipment designed to improve performance and protect wearers have elevated the game and enhanced enjoyment for both athletes and fans.

Video replay technology, tools used by referees and judges, and improvements in the cameras and recording equipment used in professional events are additional examples of innovations that have changed organized sports.

Wearable sports tech that monitors the physiological condition of the wearer — such as armbands and smart watches — and other technology innovations in sports and fitness gear and equipment help recreational exercisers and world-class athletes monitor, evaluate and build upon their fitness performance.

Yet another example of recent sports inventions is for the popular sport Pickleball — the fastest growing sport in 2022. In 2017, a new Pickleball ball was patented by a sporting goods company in Chicago, IL. Then, a foldable, deployable barrier was patented in 2021 by an individual from Plymouth, IN. In 2022, an innovative scorekeeping device and method were patented by inventors from Port Charlotte, FL.

Sports patents for these devices and designs have helped inventors realize the full value of their ideas. Obtaining a fitness industry patent can be challenging but rewarding.

Sports Patents Provide a Range of Protection for Innovators

Obtaining protection under federal patent law for your sports and athletic training innovations can help you monetize and profit from your ideas. A patent gives the holder the exclusive rights, for a period of 20 years, to use or sell the creation. In addition, patent holders also have the exclusive rights to license their invention to others. Ultimately, this gives the holder the right to decide whether to allow a third party to create, market or sell the patented products.

To obtain a patent for a sports-related product, gadget or piece of technology, your idea needs to be novel/new, and it must be unique. It also needs to be useful, and it must be possible to create. In other words, a great idea that looks amazing on paper but would be impossible to actually build would not be eligible for patent protection. Working with an experienced patent attorney/firm can help you evaluate whether applying for a patent for your idea makes sense.
