I’m excited to share with you here this next step in this process of how to file and complete a provisional patent application. This is step 9, and we’ve gone through a lot here. You’ve covered most of what is going to be required in a written description for a provisional patent application. So congrats to you if you’ve been following along and filling in your application. This is the step 9, as I said, which is covering the last aspect of uniqueness and describing again how your invention is different.
So just yesterday, we talked about your needing to describe the functionality, the use, right, how yours is different in providing that emotional big difference at the end of the day to the customer. I’m glad you got that all laid out. Now it’s time to bring it back in and make it a little bit more technical, and really this is the heart of what’s potentially patentable about your invention. It’s the structure, it’s the meat, right, the minutiae, the tiny hinges that are within your invention, and the actual shapes, and the fasteners, and the reasons why you might have omitted certain materials or descriptions, and the way that it’s curved. Every little subtle detail needs to be described in why and how it’s different from the prior art. This is going to help you explore and be able to achieve those novelty areas, and it’s gonna be a great basis for being able to assert legal argument later when you go to have claims in your non-provisional and you might have an office action up your up against with the examiner.
So, this section again, focus on just those technical how your invention is different structurally, stepwise methods and components. Think about how each step is different where you’re maybe skipping a step where you’ve added three small steps in between what’s done currently. Explore all of that and it’s as much detail as you can. There’s it again, there’s no limit here. Generally, you shoot for four to five solid paragraphs exploring each of the key components of your invention.
